1. Acceptance of These Terms
These Terms govern your use of the PointWise website at pointwise.io, the PointWise platform at app.pointwise.io, and our content operations, AI search visibility and social publishing services (together, the “Services”). By using the Services, you agree to these Terms.
If you use the Services on behalf of a company or other organization, you confirm that you have the authority to bind that organization to these Terms. If you have a signed agreement with PointWise, that agreement prevails over these Terms wherever the two conflict. If you do not agree to these Terms, please do not use the Services.
2. The Services
PointWise is a remote-first team serving B2B brands in the US, UK, Germany, Spain and Mexico. The Services include the PointWise website, the PointWise platform, content operations and AI search visibility services for B2B brands, analytics on how AI engines and search engines talk about a brand, and tools to publish content on social media, including the connector used from Claude. We may change, add or remove features over time.
3. Accounts and Access
Access to the PointWise platform is by invitation. You are responsible for keeping your login details safe and for everything that happens under your account. Workspace owners decide who has access to their workspace and with what role (owner, editor or viewer). We may suspend access that breaks these Terms or puts the Services at risk.
4. Connected Third-Party Accounts (Social Media and Google)
You can connect your own YouTube (Google), TikTok, Instagram, Facebook and X accounts to PointWise to publish content and manage comments. In this section:
Your authorization: PointWise acts only on accounts you have connected and only with your authorization, through each platform’s official login (OAuth). PointWise never asks for, sees or stores the passwords of those accounts.
What we do with a connected account: publish or schedule the videos and posts you choose, read basic profile information, read the account’s published content and its metrics, and read and reply to comments when you ask us to.
Your choices and responsibility: you choose what is published and when. You are responsible for having the rights to that content and for following each platform’s rules.
Disconnecting: you can disconnect an account at any time from PointWise settings, or revoke access from the platform itself (for Google, the Google account permissions page at https://security.google.com/settings/security/permissions; for TikTok, Meta and X, the app settings of each account). After an account is disconnected, PointWise stops accessing it and deletes its access tokens.
Platform terms: your use of each platform stays subject to that platform’s own terms: the YouTube Terms of Service (https://www.youtube.com/t/terms) and the Google Privacy Policy (https://policies.google.com/privacy), the TikTok Terms of Service (https://www.tiktok.com/legal/page/row/terms-of-service/en), the Facebook Terms (https://www.facebook.com/terms) and the Instagram Terms of Use (https://help.instagram.com/581066165581870), and the X Terms of Service (https://x.com/en/tos). PointWise uses YouTube API Services.
Platform changes: PointWise is not responsible for changes, limits or outages of those platforms, for example usage quotas, app reviews, or a platform keeping posts private until it approves the app.
5. Your Content
You (or your company) keep ownership of the content you upload or publish through PointWise, such as videos, texts and thumbnails. You give PointWise the limited permission needed to store, process and publish that content on your behalf, only to provide the Services. You confirm that you have the rights to the content and that it does not break the law or the rights of others.
6. AI-Assisted Features
Some features use AI to suggest text, for example suggested replies to comments based on your knowledge base. Suggestions are drafts: you review them and decide whether to publish them. You remain responsible for what is published from your accounts.
7. Acceptable Use
You agree not to use the Services for any of the following:
Spam, misleading content, or content that breaks the law or the rules of a platform.
Accessing accounts you are not authorized to manage.
Trying to break, overload, reverse-engineer or scrape the Services.
Sharing access links or login details with people who should not have them.
8. Fees
Paid services are billed as agreed in each customer’s proposal or agreement. Costs charged by third-party platforms, for example X API usage, may apply and are described to the customer before they are used.
9. Intellectual Property
PointWise owns the platform, software, design and brand. These Terms do not transfer any of them to you. We may use feedback you give us to improve the Services.
10. Privacy
How PointWise handles personal information is explained in our Privacy Policy, and how we use cookies in our Cookie Policy.
11. Disclaimers and Limitation of Liability
The Services are provided “as is.” PointWise does not guarantee results, such as reach, rankings or citations by AI engines, or that third-party platforms will be available without interruption. To the extent the law allows, PointWise is not liable for indirect or consequential losses, and its total liability for any claim relating to the Services is limited to the amount you paid PointWise for the Services in the twelve months before the claim.
12. Suspension and Termination
You can stop using the Services and disconnect your accounts at any time. PointWise may suspend or end your access if you break these Terms. When access ends, connected-account access is revoked and the access tokens are deleted.
13. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top shows the latest version. If you keep using the Services after we post a change, you accept the updated Terms.
14. Governing Law
These Terms, and any dispute about them, are governed by the law of the country where PointWise is registered, and the courts of that country have jurisdiction, except where mandatory consumer law says otherwise.
